This ticket (“Ticket”) is a revocable license. By purchasing and/or using Tickets to a USHL (defined below) game, the holder of this Ticket, on behalf of the holder and any accompanying minor, including a minor holding a separate ticket (individually and collectively, “Holder”), agrees that (1) use of such Tickets, and admission to the Arena (defined below), is conditioned upon Holder’s agreement to the terms and conditions set forth below, and (2) Holder will inform any quests, companions or other persons who will be using Tickets purchased by, or received from, Holder that, as Ticket holders themselves, their own use of such Tickets, and admission to the Arena, are also conditioned upon their agreement to the terms and conditions below. Holder further agrees that this Ticket is also subject to any additional terms and conditions established by the USHL, and the Fox Valley Ice Arena, its affiliates and/or related arena grounds (including, without limitation, parking areas and entry gates) (collectively, the “Arena”) at which the event or any surrounding activities (in whole or in part) for which this Ticket is issued (the “Event”) is held (collectively, all such additional terms, “Supplemental Terms”). Supplemental Terms include any health and safety requirements and other terms set forth by the State of Illinois. By acceptance and/or use of this Ticket and/or entering (or seeking entry into) the Arena, Holder is deemed to have read all such terms and agreed to be bound by them.
Holder acknowledges and agrees that the Tickets are solely for the 2023- 2024 USHL preseason, regular season and playoff games presented by Team and played at the Arena and, for the avoidance of doubt, will not include tickets, or the right to purchase tickets, to any other event or game, including, but not limited to, any USHL event (“League Special Event”) if held in Team’s market or hosted by the USHL at the Arena or otherwise in which Team may participate. Holder acknowledges and agrees that Team and/or USHL may cancel, postpone, reschedule or relocate games or events for any reason (e.g., move a regular season game of Team) from the Arena to an alternate venue for the purposes of playing a League Special Event), as determined in its/their sole discretion, as well as to modify or discontinue, temporarily or permanently, any aspect of the rules, operations and presentations of USHL games and events (“Preemption”).
If any game or Event for which Tickets have been sold to Holder is not played or presented in the Arena for any reason, including, but not limited to, Preemption, such Event will in no way be deemed, argued or construed to be a breach by Team of any terms, conditions, agreement or any other duties or obligations in connection with the sale and use of these Tickets and, in such event, Holder’s sole remedy will be a pro-rata account credit or refund equal to the price paid to Team for these Tickets, and Holder hereby waives and releases any and all claims it may have against Team and/or the USHL regarding such game(s) or Event not played or presented at the Arena.
HOLDER, ARENA, AND USHL AGREE THAT ALL DISPUTES ARISING FROM THESE TERMS AND CONDITIONS WILL BE LITIGATED IN COURT OR ARBITRATED ON AN INDIVIDUAL BASIS AND EXPRESSLY WAIVE ANY RIGHT TO LITIGATE IN COURT OR ARBITRATE ANY CLAIM AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CLASS ARBITRATION; AND, IF THE HOLDER DOES NOT CONSENT TO THIS CLAUSE, THE HOLDER MUST IMMEDIATELY LEAVE OR NOT ENTER THE ARENA.

WARNING! DESPITE ENHANCED SPECTATOR SHIELDING MEASURES, PUCKS STILL MAY FLY INTO THE SPECTATOR AREA. SERIOUS INJURY CAN OCCUR. STAY ALERT AT ALL TIMES INCLUDING DURING WARMUP AND AFTER PLAY STOPS. IF STRUCK, IMMEDIATELY ASK AN USHER FOR DIRECTIONS TO A MEDICAL STATION. HOLDER, ON BEHALF OF HOLDER AND ANY PERSON ACCOMPANYING HOLDER, INCLUDING MINOR(S), VOLUNTARILY ASSUMES ALL RISKS OF PROPERTY LOSS AND PERSONAL INJURY, ILLNESS AND ALL OTHER HAZARDS RELATED TO THE EVENT AND ATTENDING THE ARENA, WHETHER OCCURRING PRIOR TO, DURING OR AFTER THE EVENT, INCLUDING SPECIFICALLY BUT NOT EXCLUSIVELY, THE DANGER OF INJURY BY HOCKEY PUCKS, STICKS AND OTHER EQUIPMENT, BY SPECTATORS OR PLAYERS, OR BY THROWN OBJECTS, AS WELL AS EFFECTS RELATED TO THE NOVEL CORONAVIRUS, COVID-19, WHICH HAS BEEN DECLARED A WORLDWIDE PANDEMIC BY THE WORLD HEALTH ORGANIZATION, IS EXTREMELY CONTAGIOUS, AND IS BELIEVED TO BE SPREAD MAINLY FROM PERSON-TO-PERSON AND THE RISK OF WHICH CANNOT BE ELIMINATED BY PRECAUTIONS, AND AGREES THAT CS Developmental Hockey Team, LLC (“TEAM”), THE USHL AND ITS MEMBER CLUBS, THE ARENA, AND EACH OF THEIR RESPECTIVE AFFILIATES, PARENTS, SUBSIDIARIES, AGENCIES, DEPARTMENTS, SUBDIVISIONS, RELATED ENTITIES, OWNERS, GOVERNORS, TRUSTEES, OFFICERS, DIRECTORS, PARTNERS, SHAREHOLDERS, MEMBERS, PRINCIPALS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “USHL”) ARE EXPRESSLY RELEASED FROM ANY AND ALL CLAIMS ARISING FROM OR RELATING TO SUCH CAUSES OR OTHERWISE OCCURRING AT OR IN CONNECTION WITH THE EVENT, INCLUDING, SPECIFICALLY, BUT NOT EXCLUSIVELY, CLAIMS ARISING FROM, OR RELATING TO, THE NEGLIGENCE OF THE USHL.
HOLDER MUST REVIEW CAREFULLY, AND ABIDE BY, THE POLICIES OF THE ARENA AND THE USHL INCLUDING, WITHOUT LIMITATION, THE USHL FAN CODE OF CONDUCT, THE FAN GUIDE FOR THE EVENT AND ANY VENUE POLICIES, PROTOCOLS, OR PROCEDURES THE ARENA OR USHL MAY REQUIRE COMPLIANCE WITH, OR VERIFICATION OF, PRIOR TO, OR AS A CONDITION OF, ADMISSION TO THE ARENA, INCLUDING THOSE INTENDED TO PREVENT AND/OR CONTROL THE SPREAD OF COVID-19 THROUGH PERSONAL PRECAUTIONS, SOCIAL DISTANCING MEASURES, CONTACT TRACING, AND/OR PROOF OF TESTING NEGATIVE OR PROOF OF VACCINATION, AS APPLICABLE (“USHL POLICIES”). USHL AND ARENA RESERVE THE RIGHT TO REFUSE ADMISSION OR EJECT ANY PERSON THAT FAILS TO ABIDE BY ANY USHL POLICIES. USHL AND ARENA RESERVE THE RIGHT TO MODIFY ANY USHL POLICIES WITHOUT NOTICE. IF ANY PROVISION OF THIS TICKET IS DEEMED TO BE INVALID, ILLEGAL, OR UNENFORCEABLE BY A COURT OF LAW OR AUTHORIZED ARBITRATOR, THE VALIDITY, LEGALITY, AND ENFORCEABILITY OF THE REMAINING PROVISIONS WILL NOT IN ANY WAY BE AFFECTED OR IMPAIRED THEREBY.
Name/Likeness Release
By using the Ticket and attending the Event, Holder, on behalf of Holder and any person accompanying holder, including minor(s), grants the USHL permission to record his/her/their image, name, voice, likeness, actions and/or statements in any image, footage, or display, whether live or recorded, which may be taken at the Event or at the Arena, and to the use of same by the USHL at any time, for any purpose (including advertising or promotional purposes), and in any media now known or subsequently developed without additional compensation. The USHL reserves the right to modify any USHL Policies, including this release, without notice.
Unauthorized Commercial Use of Ticket / Unauthorized Transmission.
Tickets may not be used for advertising, promotion (including contests and sweepstakes) or other commercial purposes without prior written consent of the USHL and/or the Team. Any non-editorial or commercial use of any USHL or Team mark is prohibited without prior written approval of the USHL. Any unauthorized transmission, picture or other depiction or description of any game action, game information or other Arena activity is prohibited without prior written approval of the USHL. USHL reserves the right to modify any USHL Policies without notice.
ALL TICKET SALES ARE FINAL. NO REFUNDS OR EXCHANGES EXCEPT AS PROVIDED HEREIN. THE SOLE AND EXCLUSIVE REMEDY (IF ANY) IF ADMISSION IS REFUSED OR REVOKED, OR THE EVENT IS CANCELLED AND NOT REPLAYED, IS A REFUND OF UP TO THE TICKET’S FACE VALUE SET BY THE TEAM (THE “FACE VALUE”). NEITHER TEAM, USHL, NOR ARENA WILL BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR EXEMPLARY DAMAGES OF ANY KIND, OR ANY DAMAGES BEYOND THE FACE VALUE, INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF FACE VALUE FOR THIS TICKET.
Any breach of these terms, failure to comply with the USHL Policies, or the refunding to Holder of the Face Value, will automatically terminate any rights that Holder may have hereunder; will render Holder’s use of the Ticket illegal and unauthorized for any purpose; and will authorize Team and/or the USHL to revoke the Ticket, refuse admission to the Arena, or eject Holder from the Arena, without refund in each case, and subject Holder to all legal remedies available to the USHL, Team and/or Arena.
Holder and Holder’s belongings may be searched upon entry into the Arena and/or other security checkpoints, prohibited items (which may include, without limitation, bags) may be confiscated at the sole discretion of the USHL, Team and/or Arena, and Holder hereby consents to the foregoing and waives any related claims that might arise against the USHL, Team or Arena. If Holder elects not to consent, the Holder will be denied entry into the Arena without refund.
If a conflict arises between any third-party platform’s terms and these terms and conditions, these terms and conditions govern and control apply.
